This privacy policy sets out how the company Danika uses and protects the personal data of website visitors (hereinafter "Users").

Personal data collected

With regard to the personal information you may provide us with, most of it is essential and strictly necessary to respond to your requests for information, process your orders, arrange delivery, invoicing, etc. Providing this data is therefore a condition for fulfilling your requests and orders.

Beyond this, personal data may also be used for advertising and commercial purposes, in order to send you marketing communications, carry out marketing and advertising activities (for those who have not objected, or who have given their consent, depending on the case), and to measure and analyse traffic on our Site (more information on the purposes and legal bases for processing is set out below).

Depending on the processing involved, we may collect the following personal information: surname, first name, email address, age, gender, interests, phone number, postal address, order number, transaction number, banking details, unique identifiers, purchase details, purchase amounts, purchase history, customer account login and password, IP addresses, browsing preferences, pages visited, and interactions.

Regarding banking data, payments are made via the secure payment platform. This data is not collected by the company Danika, which has no access to it and therefore does not retain it.

In certain cases, the company Danika may collect information provided by the User about third parties, for example if the User has an order delivered to a third party's home. In this case, the personal data provided will only be used to fulfil the User's request.

Personal data is collected either through direct communication from you, or when you browse our Site, via the use of cookies (more information on the use and management of cookies below).

The personal data referred to above may therefore be collected at various points:

- when you browse the Site;

- when you contact us and request information on the Site;

- when you place an order.

Purposes of processing and legal bases

Personal data processing carried out by the company Danika is based on Article 6(1) of the GDPR, points (a), (b), (c), (d), (e) and (f).

Your personal data will be processed for the purpose of performing a contract or pre-contractual measures, in particular for the management and administration of contracts (management of customer accounts, orders, deliveries, order tracking, invoicing, complaints, etc.). The User is required to provide the data necessary for the performance of the contract; without it, it will not be possible to fulfil the purpose of the contract. To this end, the User should only provide data that is necessary for entering into and performing the commercial or pre-contractual relationship, or whose collection is required by law. If we request data beyond what is necessary, the User will be expressly informed of the voluntary nature of that disclosure.

 

Your personal data will be processed on the basis of your consent in the following cases:

- Managing and responding to requests for information. The company Danika uses the User's personal information to process their request and to contact them again by phone, email or post;

- Managing and sending commercial and promotional information tailored to the User's profile and, relating to our activities, new products and special offers, by email (subject to the User's consent). Consent to this newsletter can be withdrawn at any time by clicking the unsubscribe link or following the unsubscribe instructions included in our emails;

- Improving the browsing experience, personalising content on the Site and offering targeted advertising;

- Responding to the exercise of rights of access, rectification, erasure and objection, as well as to questions and complaints;

Your personal data will be processed for the purposes of legitimate interests pursued by us or by third parties in the following cases (our legitimate interest being to be able to ensure that our Site remains secure, and to help us understand the needs, expectations and satisfaction levels of Users and customers, so as to improve our services and products and thereby improve customer satisfaction):

Management of personal accounts and passwords

Every User has the option of creating a customer account on the Site, to make identification and order tracking easier.

To create an account, the User is asked to enter their email address and choose a password. This account and password are strictly personal, and the User is solely responsible for keeping them confidential.

The User is responsible for all use of this account and password. The company Danika cannot, under any circumstances, be held liable for any loss or damage of any kind resulting from the use of your account and/or password.
The User undertakes to inform the company Danika immediately of any unauthorised use of their account and/or password, and to make sure they are logged out after each visit to the Site.

Sharing and transfer of personal data

The User agrees that their personal data may be transferred to third-party technical service providers for the purposes of collecting data and providing services, for example for payments, shipping and delivery, hosting, data administration and management, and the administration of certain services and features.

In this respect, the User consents to the transfer of this data, in particular to technical service providers located outside the European Union, who will have put in place appropriate safeguards to secure the data, in particular standard contractual clauses.

Personal data may also be shared with other third parties where necessary to: (i) comply with a judicial or administrative request or with the application of a law; (ii) prevent unlawful use of our Site; (iii) defend ourselves against claims made by third parties; and (iv) provide assistance in preventing fraud.

Personal data may also be transferred to a third party in the event of a merger, sale of assets, or any other restructuring of the company Danika.

Data retention period

Personal data is kept for as long as necessary to fulfil each of the purposes set out above, and within the limits set by law.

In the context of contractual relationships, personal data will be kept by the company Danika for a period of five (5) years from the end of the relationship.

In other cases, personal data is kept for a maximum of three (3) years from the User's last contact with us.

However, certain information is kept for longer as part of interim archiving, so that the company Danika can meet its legal, accounting and tax obligations, and so that it can handle any complaints, within the applicable limitation periods and until all rights of appeal have been exhausted in the event of a dispute.

As for cookies, these have specific retention periods (detailed below).

Security

The company Danika implements organisational, technical, software and physical digital security measures to protect personal data against unauthorised alteration, destruction, disclosure or access.

However, the User acknowledges that the internet is not a perfectly secure environment, and the Site cannot guarantee the security of information transmitted or stored over the internet.

The Site may contain links to other websites, the content of which is not controlled by the company Danika.

Consequently, the company Danika cannot be held responsible for the protection and confidentiality of information provided by the User when visiting these websites, and these websites are not governed by this privacy policy.

Control over your personal information

When exercising their right of access to personal data concerning them, the company Danika may, before acting on this right, ask for proof of the User's identity in order to verify it.

We will respond within a maximum of one month from the date our teams receive your request.
